Welcome to poll2go. By creating an account or using poll2go as a creator or voter, you agree to these Terms of Service. Please read them carefully.
poll2go is an online polling platform operated by the individual or entity identified in our Imprint (Impressum). poll2go acts as an intermediary and hosting service within the meaning of the Digital Services Act (EU Regulation 2022/2065).

You agree to use poll2go only for lawful purposes and in accordance with these Terms. Specifically, the following are prohibited:
Poll content (questions, answer options, and any associated text) must comply with all applicable laws in your jurisdiction and in the jurisdiction of your intended audience.
You are solely responsible for the content you create. poll2go does not pre-screen poll content, but we reserve the right to remove content that violates these Terms or applicable law, including at the request of competent authorities.
Content that is particularly likely to be removed includes content that is illegal under EU law or the laws of Austria, including but not limited to: hate speech, incitement to violence, terrorist content, CSAM, content that infringes intellectual property rights, and content that violates privacy rights.
To create polls, you must register for a creator account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under your account.
You agree to provide accurate information during registration and to keep your contact email current. We may use your email to send important service notifications.
Voting does not require an account. However, to prevent duplicate votes and ensure the integrity of poll results, we collect certain technical identifiers (IP address hash, browser fingerprint hash, and a session cookie) after you provide explicit consent.
By casting a vote after providing consent, you agree that this limited technical data may be processed for fraud prevention. See our Privacy Policy for full details.
If we determine that content or conduct violates these Terms, we may take one or more of the following actions:
We aim to act proportionately. Where it is safe and practical to do so, we will notify the affected creator before taking action, except where doing so would prejudice an ongoing investigation or where immediate action is necessary to prevent harm.
If we take action against your content or account, you have the right to appeal that decision. To submit an appeal, please email:

If you encounter content on poll2go that you believe is illegal, you can report it using our content report form:
We will review all reports and respond with a reasoned decision. You will receive an automatic acknowledgement email on submission and a decision email once we have reviewed your report, in accordance with DSA Art. 16(5).
poll2go and its original design, features, and functionality are owned by the operator and are protected by applicable intellectual property law. You may not copy, modify, or distribute any part of the platform without express written permission.
By creating a poll, you represent that you own or have the right to use all content you submit, and you grant poll2go a limited, non-exclusive licence to store and display that content for the purposes of operating the service.
To the fullest extent permitted by applicable law, poll2go and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or loss of goodwill.
Our aggregate liability to you for any claim arising out of these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim (which for free-tier users is zero). Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded by law.
These Terms are governed by the laws of Austria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Austria, unless mandatory consumer protection law in your jurisdiction requires otherwise.
poll2go is currently provided as a beta service. By creating an account or using poll2go during the beta period, you acknowledge and accept the following:
The limitations in this section supplement the Limitation of Liability in Section 11 and apply specifically to the beta period. Once poll2go exits beta, a revised version of these Terms will be published.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where possible, notify registered creators by email. Your continued use of poll2go after a change constitutes your acceptance of the revised Terms.
Your use of poll2go is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
